These Terms of Service govern your access to and use of PathH₂O as an individual user. By creating an account or using the platform, you agree to these terms.
1. Eligibility & accounts
You must be at least 16 years old and able to form a binding contract to use PathH₂O. You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for activity that occurs under your account.
2. What PathH₂O is — and isn't
PathH₂O is a study, exam-practice, and compliance-tracking tool for water and wastewater operators across U.S. states. It is an independent platform and is not affiliated with, endorsed by, or an official source for any state licensing authority. Practice exams are study aids and do not guarantee any exam result or certification outcome. Always confirm requirements with your state licensing authority.
AI-generated study content. Many of our practice questions, answer explanations, and study materials are created or assisted using artificial-intelligence tools. Although we review and continually improve this content, it may contain inaccuracies, be incomplete, or become outdated. It is provided as a study aid only — it is not legal, professional, or official examination guidance — and should always be verified against your state licensing authority's official materials before you rely on it. If you notice a problem, please use the in-app “Report” tool so our team can review and correct it.
3. Acceptable use
You agree to use PathH₂O lawfully and not to misuse it. Prohibited conduct is described in our Acceptable Use Policy, which is incorporated into these terms.
4. Subscriptions & billing
- Paid plans renew automatically until cancelled. You can cancel anytime; access continues through the end of the current billing period.
- Fees are charged through our payment provider in U.S. dollars and are non-refundable except where required by law.
- We may change pricing with reasonable notice; changes apply to subsequent billing periods.
5. Your content
You retain ownership of the information you submit (such as your licenses, CE logs, and experience). You grant us a limited license to use that information solely to operate and provide the service to you and, where applicable, your organization.
6. Intellectual property
PathH₂O, including its software, content, and study materials, is owned by us or our licensors and is protected by law. You may not copy, resell, reverse-engineer, or create derivative works from the platform except as permitted by these terms.
Our practice questions, answer explanations, and study materials are original works created by or for PathH₂O — in part using artificial-intelligence tools — and are not copied or reproduced from any third party's copyrighted examinations, question banks, or proprietary materials. If you believe any content infringes your intellectual-property rights, contact us at support@philantrac.com and we will promptly review and, where appropriate, remove it.
7. Disclaimers
The platform is provided “as is” without warranties of any kind. We do not warrant that content is complete, current, or error-free, or that use of the platform will result in passing any exam or obtaining any license.
8. Limitation of liability
To the maximum extent permitted by law, PathH₂O and its affiliates will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the platform. Our total liability is limited to the amount you paid us in the twelve months before the claim.
9. Termination
You may stop using PathH₂O at any time. We may suspend or terminate access if you violate these terms or use the platform in a way that harms others or the service. Provisions that by their nature should survive termination will survive.
10. Changes & governing law
We may update these terms; continued use after changes means you accept them. These terms are governed by the laws of the United States and the state in which PathH₂O is established, without regard to conflict-of-law rules.
